The long-standing legal battle surrounding the Krishna Janmabhoomi-Shahi Idgah dispute in Mathura continues to unfold in the Allahabad High Court. The latest hearing, presided over by Justice Ram Manohar Narain Mishra, has now been scheduled for March 5, 2025, marking another critical juncture in this complex legal contest.

Background of the Dispute

The controversy revolves around the Shahi Idgah mosque, which is alleged to have been constructed during the Mughal era under Emperor Aurangzeb, purportedly after demolishing a temple at what is believed to be the birthplace of Lord Krishna. The Hindu petitioners have filed 18 suits seeking possession of the disputed land, removal of the mosque structure, and restoration of the temple.

Judicial Proceedings So Far

  1. Maintainability of Suits: On August 1, 2024, the Allahabad High Court upheld the maintainability of the suits filed by Hindu worshippers, rejecting the Muslim side’s challenge. The court ruled that the suits were not barred by the Limitation Act, Waqf Act, or the Places of Worship Act, 1991, which prohibits alteration of religious structures as they existed on August 15, 1947.
  2. Consolidation of Cases: On January 11, 2024, the court ordered consolidation of all related suits, streamlining the legal process for efficient adjudication. An application by the Shahi Idgah mosque committee to recall this order was dismissed on October 23, 2024.
  3. Recent Developments: During the latest hearing, the Muslim side sought an amendment to its petition. However, as the Hindu side had not received a copy of the amendment application, the court directed its submission and set the next hearing for March 5, 2025.
